The city of San Diego has agreed to pay $18.5 million to the family of a young boy who lost his leg after he was struck by a city trash truck.
The personal injury settlement was reached yesterday, May 20, 2013, the day the case was scheduled for trial. ?The $18.5 million settlement is the largest personal injury settlement in the city of San Diego. ?The Attorney for the City said that what happened to the child was a tragedy and commented ?This isn?t really a situation of anybody winning or losing; the city felt it was in the best interest of everyone to resolve the case without a trial.?
The child was struck in November 2011 and suffered major internal injuries and broken bones. His left leg was amputated. ?Since the accident, the child, now 10 years old, has undergone more than 50 operations and still battles massive internal injuries. The family filed their personal injury lawsuit in San Diego Superior Court, accusing the city of negligently hiring, training and supervising the driver of the trash truck. The city truck driver was making an illegal and dangerous ?T?turn near an elementary school, and he was on his cellphone. It was also discovered that the driver had more than a dozen traffic violations. The witness who testified that the driver was on his cellphone when he ran over the child said: ?I was trying to get his attention to tell him and he was on the cellphone?.
The settlement will be set aside for the boy and will be used for a lifetime of medical challenges. ?He is currently using a?prosthesis?which will need?constant?attention as he grows.
