EAST RUTHERFORD, N.J. (AP) ? The New York Jets were a delicious treat for the San Francisco 49ers.
San Francisco used a solid running game, a smothering defense, a little bit of the wildcat-style offense and even blocked a punt to cruise to a 34-0 victory. That romp came a week after a loss at Minnesota in which the 49ers were just as outclassed as the Jets were Sunday.
"For sure, the whole week there was more of an edge; it was just a bad taste in your mouth," Alex Smith said. "I don't think that goes away in one day. We wanted to be 3-1 and got it done."
They got it done so emphatically that Jets coach Rex Ryan was visibly shaken by the lopsided defeat, so much so that he struggled to describe how poorly his Jets (2-2) performed.
"It's obviously unacceptable," Ryan said. "It starts with the coaches. The players ... they've got to dig deep, look down at the themselves."
Ryan took no solace from his team losing to one of the NFL's best. San Francisco (3-1) has everything Ryan wishes his team did.
The 49ers ran for 245 yards and Carlos Rogers returned a fumble 51 yards for a touchdown.
Frank Gore, Kendall Hunter and backup quarterback Colin Kaepernick ? on a wildcat-like option ? all ran for scores. The defense had an interception and three fumble recoveries, and special teams blocked Robert Malone's punt to set up the final touchdown.
Defensive end Aldon Smith called it a statement win.
"Yeah, that's right," he said. "After the last game, some people were questioning us and we knew what we were capable of. We played all together as a unit and proved what we are as a defense."
And as an offense. And on special teams.
Rather than head back to the West Coast after the Minnesota loss, coach Jim Harbaugh chose to have his team stay in eastern Ohio and practice at Youngstown State all week. Last season, the 49ers did the same thing and won both games, in Cincinnati and then at Philadelphia. The 49ers wound up going to the NFC championship that season, and if they play anything like they did against the Jets, they could very well find themselves advancing deep into the postseason again.
"This is more the way we are accustomed to playing," said Harbaugh, the 2011 Coach of the Year.
It was San Francisco's first shutout since beating the St. Louis Rams 26-0 last December.
Meanwhile, the Jets lost top wide receiver Santonio Holmes to what appeared to be a serious left foot injury. It was the first time New York was shut out since losing 9-0 to Green Bay on Oct. 31, 2010, and the Jets' biggest shutout home loss since falling 37-0 to Buffalo in 1989.
If Holmes misses significant time, the Jets would be without their two biggest playmakers after All-Pro cornerback Darrelle Revis was likely lost for the season with a torn ligament in his left knee last week at Miami.
"We got to play with who we've got," Mark Sanchez said. "None of those guys are going to get better overnight."
On the first play of the fourth quarter, Holmes caught a pass from Sanchez for 4 yards, but his left leg appeared to go out on him. The ball flew out of his hands, and Rogers picked it up and returned it for a score.
Holmes left the stadium in a golf cart, holding crutches, his left foot in a boot.
Ryan said Friday that the Jets would wait to put Revis on injured reserve until he has surgery in a few weeks, keeping him available in case New York goes to the Super Bowl. If the Jets play like this the rest of the way, getting to the playoffs will be a tall task.
Alex Smith was efficient, going 12 of 21 for 143 yards and no touchdowns, but more importantly, no interceptions. Sanchez had another poor game, going 13 of 29 for 103 yards and an interception.
"We knew Sanchez holds the ball a little longer and we felt we could get after him," Aldon Smith said. "We pretty much did."
New York finished with just 45 yards rushing.
The wildcat-style offense worked early ? but for the 49ers and not Tim Tebow and the Jets.
Kaepernick put the 49ers up 7-0 early in the second quarter, taking a direct snap and running untouched off left end for a 7-yard touchdown. Kaepernick also had a 17-yard run earlier in the game.
On the Jets' next possession, Tebow threw his first pass with New York, a short one over the middle to tight end Dedrick Epps, who was upended immediately by Dashon Goldson as the ball came loose. Rogers recovered, and the fumble call was upheld by video review. Epps injured his right knee on the play.
With just over a minute left in the first half, the 49ers were aggressive despite starting the drive at their 26. A 23-yard catch by Vernon Davis on first down got things rolling, and San Francisco ended the half on David Akers' 36-yard field goal.
Boos and some chants of "Tee-boww! Tee-boww!" rang out as the Jets went three-and-out for the second straight possession in the second half. It never got any better for New York.
NOTES: Mario Manningham, a Super Bowl hero with Giants before joining the Niners as free agent, returned to the Meadowlands and had three catches for 47 yards, plus a 28-yard gain on an end-around ... Akers also missed from 55 and 40 yards wide right ... New York lost fullback John Conner with a hamstring injury ... San Francisco got 62 yards rushing from Gore, 56 from Hunter and 50 from Kaepernick.

UNITED NATIONS (AP) ? Iraqi Foreign Minister Hoshyar Zebari has proposed a two-stage plan to bring both sides of the Syrian conflict together to discuss a political transition.
Zebari said in an interview that he made the proposal at a ministerial meeting Friday of 20 countries mainly opposed to the government of President Bashar Assad of Syria.
The first stage would be to bring together the countries that endorsed a blueprint leading to a political transition that was adopted in Geneva on June 30 to now focus on implementing that blueprint, he said.
Zebari said the second stage would be to invite representatives of the government and the opposition to a conference in a neutral place.
He said that international envoy Lakhdar Brahimi would have to carry the plan forward.

Bush Hill Arty expected to complete hat-trick
The way Bush Hill Arty performed in his last three open races was really hilarious. It was greatly amazing for the spectators who watched the O'Brien trained black dog fighting in the playfields.
As the two-year-old novice hound gets ready to heat up his feet in the high-profile race of Ray Mulvaney Quick-fire Open 350 Final, most of the sport fans believe that he will be able to win convincingly tonight.
This is going to be the young dog?s fourth trip to Shelbourne Park. He did well in the previous races. So, we can expect that he will not take it as a big issue to outplay five mighty rivals while running over 350 yards.
The best thing about the rookie runner is that he has summed up immense momentum from his two recent OR triumphs, and now, he wants to complete hat-trick at every cost.
The talented son of Scarty Lad out of Bush Hill Pride started his career in January 2012. He managed to break his maiden by winning an A5 race with two lengths? margin on May 12.
After three pathetic performances, he won an A3 race over 525 yards on July 20. That was followed by a S3 victory in August.
With the dawn of September, Bush Hill Arty picked up some miraculous momentum that helped him finish as the runner-up in his first open race entitled as Bet With The Tote Open 350. After winning the very next race by a length?s margin, he impressed all by bringing home the title of Ray Mulvaney Quick-fire Open 350 Semi-final in his last start.
What a record! These stats show how effective the dog is in OR format of the game. However, he will have to be wary of the hot-favourite rival, Bulmers Baby, tonight.
The J. McGee trained black bitch has won a number of open races since the dawn of the calendar year. Her last title was the Ray Mulvaney Quick-fire Open 350 Semi-final that she bagged on September 26.
So, a fierce battle between the dog and the bitch is on the way. Let us enjoy it. Good luck to both the runners.

Yesterday I had to practice what I preached.? Again.
A neighbor stopped by while I worked in the yard. Her daughter is a friend of eldest?s, so I invited them inside. I warned the mom, ?The house is a wreck. A huge messy mess. I?m just going to treat you like family right off the bat, OK??
She laughed. ?We are family.?
?Then come in. And watch your step.?
Entering the disaster zone with her fresh eyes, though, was soooo challenging! I hadn?t realized it was that bad. Unfinished laundry piled on all available surfaces in the family room. Puzzles and game covered the dining table. Rachel?s nest of papers loomed in the corner. Books stacked on the toy chest and spilled toward the trampoline.
And the kitchen? You cannot imagine! Dishes ran rampant in and around the sink. Plus, I was in the middle of removing wallpaper from the kitchen, so wallpaper scraps sat in sad heaps all around the room amidst the steamer and all its accessories.
Worse, everything was in half-stages of completion. My ADD was in full swing today. The kids were so rowdy that I had escaped my inside tasks and started mowing the lawn to get some peace and quiet, if that tells you anything about the day. Even the lawn had high spots where I had gotten distracted and moved to another task.
All this went into inviting a neighbor into my house for the first time. She handled it like a champ, though. She found the only empty chair and sat, talking to me as I dripped sweat on the kitchen floor?it?s hot in Texas in August.
I sighed and shook my head. ?You?ll probably tell your daughter never, ever to eat anything at my house. Ever. I?m so sorry it?s such a mess. Believe it or not, I used to be a perfectionist. My?article, ?Messy House Ministry,? was published after a moment just like this when I had to learn to be hospitable even though I was far from perfect.?
She let loose a wonderful, musical laugh. ?Honey, you are BUSY.?
In the end, she invited me to her house, which was BEAUTIFUL BTW, and gave me some yum-o chicken salad. The important thing, though, was that I made a new friend, one that is OK with my imperfections and will hopefully be comfortable sharing her life with me. The embarrassment does lessen with time, but I still don?t like letting people see me in all my imperfect glory.
God, though, loves us even while we are far from perfect. I feel that showing my true self, rather than a magazine facsimile, helps people feel more comfortable around me.
How about you?

The Seattle Sounders are hands down ? sorry Portland and everywhere else ? the success story of Major League Soccer as a young league. They lead the league in attendance and in-stadium passion (if, perhaps, not passion per person).
And they had one of the first major jersey sponsors (xBox), which leads us inextricably to today?s topic: The deal runs out at the end of the 2013 season, and majority owner Joe Roth doesn?t sound too optimistic about resigning with the Microsoft. In fact, he sounds downright negative about the prospect.
A block quote to get us started:
?They?ve just had a very unimaginative conversation over the course of the past year. They see things differently than we do. ?They?ve been great partners, and I wish they?d stay on. I wish they would see it the same way that we do? If it was close, we would have caved like an accordion. I came to believe after a long series of negotiations that they weren?t interested.?
And that?s fine. xBox is allowed to make business decisions, as are the Sounders. But it will be interesting to see how much the club can command on the open market. The Galaxy lead MLS at $4.4 million per season. The Sounders will be looking to get more than that for their shirts.
And here?s hoping they do so because this is more than just a Sounders issue. The relative success or failure of Seattle to sign a new sponsor for multiple millions will be felt league-wide. Television ratings are improving, but not quickly enough to drive huge new deals with the networks. One way to make up for that lack of cash is to sign jersey sponsors for increasing amounts of money. (It?s a drop in the bucket compared to a massive television contract, but a $5 million-plus-sized drop ain?t too shabby, you know?)
The bottom line: Other teams will be watching the Sounders closely to see how the negotiations go, hoping for dollar signs and lots of them.

BEIRUT (AP) ? Syrian authorities on Thursday sent text messages over cell phones nationwide with a message for rebels fighting President Bashar Assad's regime: "Game over."
The messages signed by the Syrian Arab Army also urged the rebels to surrender their weapons and warned the countdown to evict foreign fighters has begun. The texts appear to be part of the regime's psychological battle against the rebels, but are highly unlikely to have any effect on fighters intent on toppling Assad.
Syrians say they began receiving the messages a day after rebels bombed a military command center in Damascus ? a major security breach of the heavily guarded capital that highlighted the regime's growing vulnerability in the face of a rebellion growing in confidence and capabilities.
People with cellular subscriptions received the messages while those with prepaid phones did not, residents in the Syrian capital said.
Despite the high-profile attack, the two sides have been locked in a stalemate after 18 months of conflict. Activists say the death toll since the conflict began in March last year has recently topped 30,000, with nearly two-thirds of the casualties reported in the past six months.
In August, Syrian army helicopters dropped leaflets warning rebels in Damascus to hand over their arms and seek amnesty.
In Geneva on Thursday, the United Nations' refugee agency said the U.N. and its partners are launching a revised appeal for $487.9 million to help support Syrian refugees. It said 2,000 to 3,000 refugees are crossing into neighboring countries each day.
The UNHCR said 294,000 Syrian refugees are registered or awaiting registration in neighboring countries.
Earlier Thursday, a Lebanese TV station broadcast footage showing Syrian government troops driving rebels from a building they had briefly occupied a day earlier after a double car bomb attack struck army headquarters in Damascus.
The images from Lebanon's Al Manar TV station further demonstrated the scale of the security breach of the heavily guarded capital by rebels determined to topple the Assad regime.
The fighters detonated car bombs that engulfed the army headquarters in flames, followed by three hours of gunbattles in and around the compound Wednesday.
The government said four army guards were killed and 14 people were wounded, including civilians and military personnel.
The carefully orchestrated attacks were the most dramatic security breach in the center of the capital Damascus since July, when rebels detonated explosives inside a high-level crisis meeting in Damascus that killed four top regime officials, including Assad's brother-in-law and the defense minister.
They highlighted the regime's growing vulnerability, even as the 18-month battle to bring down Assad is locked in a stalemate.
Al Manar's correspondent Youssef Shaeito said he accompanied Syrian troops on Wednesday as they stormed the compound after the explosions. In an interview with the station, he said he saw the bodies of three gunmen inside, suggesting clashes between government forces and rebels inside the building.
The station is owned by the Lebanese Hezbollah militant group, a strong ally of Assad's regime. Syrian state-run media, however, reported only on the car bombs, omitting any mention of clashes inside the building.
Exclusive Al Manar footage showed a group of soldiers surrounding a building at the compound and shooting at targets inside. Shortly afterward, a pickup truck with a heavy machine gun mounted on it joins the battle.
Eventually, dozens of troops are seen storming the building and going up the stairs from one room to the other amid smoke. The bodies of three gunmen are seen on the floor, one of them with an apparent suicide belt tied around his waist.
Shaeito said that in the mayhem following the explosions, gunmen had infiltrated the army command headquarters, taken up positions and begun shooting at soldiers. He said the gunmen "moved from floor to floor and room to room" and tossed grenades at soldiers outside.
He said it took soldiers about 45 minutes before they were able to storm the building.
International diplomacy has failed to stop the bloodshed in Syria. Syrian activists said more than 305 people were killed across Syria on Wednesday, making it one of the deadliest days since the conflict began.
They included at least 40 people whose bodies were discovered in a suburb of Damascus, some of whom appeared to have been killed execution-style. The exact circumstances in which the victims were killed remain unclear because of strict restrictions on the media.

Effects of Alcohol Consumption: Excessive consumption of alcohol can cause a lot of health problems, which include strokes, cirrhosis, accidents, sleep disturbances, and suicide. There are several adverse health problems that can arise because of excessive alcohol consumption. It is advisable to know about the risks before opting to drink.
Safe drinking: You need to know if the amount of alcohol that you consume is safe for you or not. If you are pregnant or have any medical problems, then you should not drink. Research has also shown that moderate consumption of alcohol can reduce the risk of heart disease.
The safe amount is two drinks per day for men and a drink a day for women. If you drink more than this per day or even binge over the weekends, then drinking can be hazardous to your health.
Alcohol Related Health Problems:
Accidents ? If you drink a lot, then it leads to motor skill impairment. This means that people become more prone to accidents and injuries can be serious.
?
Studies have shown that several car accidents in the United States happen because of drunk driving.
Cancer ? Alcohol can also increase the risk of certain cancers of the liver, breast, esophagus, mouth, lips, larynx, pharynx, and gastrointestinal tract.
Cirrhosis ? Heavy drinking can cause cirrhosis of the liver and a lot of people die of this.
Digestive disturbances ? Digestive problems and heartburn are some of the problems that people suffer from if they drink heavily.
Heart disease ? Binge drinking and drinking too much can increase the chances of heart disease. People who already suffer from cardiovascular disease can die suddenly if they drink heavily.
Hemorrhagic stroke ? People who drink a lot are more at risk of getting hemorrhagic strokes.
High blood pressure ? People who drink more than three or four drink a day have a higher risk of getting high blood pressure.
Immune system suppression ? The immune function is suppressed because of excessive consumption of alcohol. So people who are heavy drinkers often take more time to recover from diseases and infections.
Neurological disorders ? Neurological disorders and alcohol-related dementia can lead to memory loss and cognitive impairment in heavy drinkers.
Obesity ? There are a host of other health problems that can happen because of obesity. Since alcohol has high sugar content, diabetes is one of the main health problems that can happen.
Pancreatitis, performance deficits, and poor judgment are some of the health problems that can happen because of excessive consumption of alcohol.

NEW YORK (AP) ? Stocks notched their first gain of the week Thursday after Spain announced severe budget cuts intended to convince the world that it can meet deficit-reduction targets.
It was the best day for the U.S. market since Sept. 13, when Federal Reserve Chairman Ben Bernanke announced further steps by the central bank to speed the economic recovery.
Stocks were also helped by speculation that the central bank of China will act soon to help the world's No. 2 economy.
The Dow Jones industrial average climbed 72.46 points, or 0.5 percent, to close at 13,485.97. It was the Dow's first gain in five trading sessions. The average was up as much as 109 points after the Spain announcement.
The Standard & Poor's 500 index, after five days of declines, closed up 13.83 points, or just shy of 1 percent, at 1,447.15. The Nasdaq composite index rose 42.90 points to 3,136.60.
The Nasdaq and S&P were helped by a jump in Apple stock, reversing three days of declines. Apple gained $16.14, or 2.4 percent, to $681.32 despite an analyst's report reducing estimates for shipments of iPhones later this year.
As fear grew that Spain will need an international bailout, the finance minister said a draft budget for 2013 cuts overall spending by ?40 billion, or about $51 billion. He said cuts for ministries would average almost 9 percent.
The cuts are meant to show world investors and other countries that Spain can meet fiscal targets. The budget unveiling, shortly before noon EDT, lifted the U.S. stock market from what had been only modest gains.
"That's the only major thing that's happened," said Dan Greenhaus, chief global strategist for the brokerage BTIG. "It's an excuse to rally the stock market."
Technology stocks and energy companies made the biggest gains. Utility stocks, which tend to do well when investors are fearful, were the only industry group in the S&P to fall.
The market gains started earlier, in Asia, helped by expectations that the People's Bank of China will act soon. China's biggest steelmaker said Thursday it has shut down a mill in Shanghai, a sign of weakening growth.
Stocks rose 0.5 percent in Japan and 1.1 percent in Hong Kong.
In the United States, investors grappled Thursday with mixed economic data:
? The economy grew at an annual rate of 1.3 percent from April through June, the government said, slower than the previous estimate of 1.7 percent and not nearly fast enough to reduce unemployment.
? Demand for long-lasting manufactured goods plunged in August by the most since January 2009. That was mostly because of a huge drop in commercial aircraft orders, which are volatile. Orders that reflect business investment rose solidly.
? The number of Americans seeking unemployment benefits fell 26,000 last week to 359,000, the lowest figure in nine weeks. A figure consistently below 375,000 is generally enough to lower the unemployment rate.
? The number of Americans who signed contracts to buy previously occupied homes fell in August from a two-year high in July. The National Association of Realtors' sales index is still 10 percent higher than it was a year ago.
In Europe, stocks came back from one of their worst days in months. The benchmark stock index finished 0.7 percent higher in France and 0.2 percent higher in Germany and Britain.
Borrowing costs for financially troubled Spain and Italy also edged down, a positive sign.
In the U.S., demand for government bonds fell, generally an indication that investors are more willing to embrace risk. The yield on the 10-year note, which moves opposite the price, rose 0.03 percentage point to 1.65 percent.
The price of crude oil rose $1.87 per barrel to $91.85 as concerns mounted about a potential military confrontation over Iran's nuclear program. Oil had dropped $9 a barrel in two weeks.
Israeli Prime Minister Benjamin Netanyahu warned at the United Nations that Iran will have enough enriched uranium to make a nuclear bomb by next summer and urged the world to draw a "red line" to stop it.
The dollar fell against the euro and pound but rose against the yen.
Among other U.S. companies making moves:
? Tempur-Pedic International, the mattress company, climbed $3.86, or 14.4 percent, to $30.64 after announcing it would buy a rival, Sealy, for about $229 million in cash.
? Discover Financial Services rose $2.69, or 7.3 percent, to $39.71. It reported a slight earnings decline in its latest quarter but beat Wall Street expectations. It also said credit card use increased and more customers paid off cards on time.
? GE hit a four-year high after the company told analysts it expects industrial revenue to rise about 10 percent this year. GE gained 63 cents, or 2.9 percent, to $22.73 in afternoon trading. They rose as high as $22.86.

ScienceDaily (Sep. 25, 2012) ? Robotic surgery though the mouth is a safe and effective way to remove tumors of the throat and voice box, according to a study by head and neck cancer surgeons at the Ohio State University Comprehensive Cancer Center -- Arthur G. James Cancer Hospital and Richard J. Solove Research Institute (OSUCCC -- James).
This is the first report in the world literature illustrating the safety and efficacy of transoral robotic surgery for supraglottic laryngectomy, the researchers say.
The preliminary study examined the outcomes of 13 head and neck cancer patients with tumors located in the region of the throat between the base of the tongue and just above the vocal cords, an area known as the supraglottic region.
The study found that the use of robot-assisted surgery to remove these tumors through the mouth took about 25 minutes on average, and that blood loss was minimal -- a little more than three teaspoons, or 15.4 milliliters, on average, per patient. No surgical complications were encountered and 11 of the 13 patients could accept an oral diet within 24 hours.
If, on the other hand, these tumors are removed by performing open surgery on the neck, the operation can take around 4 hours to perform, require 7 to 10 days of hospitalization on average and require a tracheostomy tube and a stomach tube, the researchers say.
The findings were published recently in the journal Head and Neck.
"The transoral robotic technique means shorter surgery, less time under anesthesia, a lower risk of complications and shorter hospital stays for these patients," says first author Dr. Enver Ozer, clinical associate professor of otolaryngology at the OSUCCC -- James.
"It also means no external surgical incisions for the patient and better 3-D visualization of the tumor for the surgeon," says Ozer, a head and neck surgeon who specializes in robot-assisted techniques.
The cases examined in this study were part of a larger prospective study of 126 patients undergoing transoral robotic surgery between 2008 and 2011.
Other Ohio State researchers involved in this study were Bianca Alvarez, Kiran Kakarala, Kasim Durmus, Ted N. Teknos and Ricardo L. Carrau.

Kiobel v. Royal Dutch Petroleum Company, Monday, Oct. 1: The term opens with a case held over from last year?in a way that doesn?t bode well for Esther Kiobel. She sued Royal Dutch Shell in 2002 on behalf of her late husband and 11 other Nigerians, saying that the company colluded with the Nigerian military in the 1990s to silence protesters?going so far as torturing and killing them?who were trying to halt oil exploration. Last term, when the court first heard the case, the question was whether corporations could be sued for human rights abuses. Cue lots of bitterness on the left about how the court could treat companies as people for the purposes of campaign donations, but not when it comes to accusations of murder.
Now the case is back to resolve a more basic question: Can Esther Kiobel sue in the United States over this alleged breach of international law on foreign soil? The law at issue is the Alien Tort Statute, passed in 1789 to combat piracy, among other things. No one much used it until the 1980s, when it became a weapon for fighting human rights abuses. In 2004, in a case out of Mexico, the court said it was OK to use the statute for claims based in ?universally condemned human rights violations,? as the plaintiffs put it. Genocide, torture, and human trafficking should count along with piracy. Will a majority of justices now retreat from that position, foreclosing the American courts to people like Esther Kiobel? Or will conservative justices like Antonin Scalia prefer to read the law based on its historical roots, thus keeping this 1789 statute alive?
Ryan v. Gonzales and Tibbals v. Carter, Tuesday, Oct. 9: We are not supposed to execute mentally insane people in this country. The Supreme Court said so in 1986. At the time, no state allowed such an execution; as Justice Thurgood Marshall pointed out, British judges back in the 17th century worried about the ?miserable spectacle? of ?extreme inhumanity and cruelty? presented by executing a ?mad man.? That?s still the law, though it?s worth worrying over the low standard of competence courts use. Apart from that, what exactly is supposed to happen if a defendant is sentenced to death and then found to be incompetent, because of mental illness, to help his lawyer press his appeals?
Two federal appeals courts, the 6th Circuit and the 9th Circuit, have essentially found that defendants have a right to be competent during the federal court proceeding called habeas corpus?basically, a defendant?s last-ditch chance to get off death row. The 9th Circuit stayed proceedings indefinitely in the case of Ernest Valencia Gonzales, who is psychotic, and who killed a man in the course of a burglary. In Ohio, a district court similarly ordered an indefinite stay for Sean Carter, sentenced to die for killing his adoptive grandmother, and then found to be delusional with schizophrenia. The state of Ohio, which wants to execute Carter, imagines courts handing out lots more delays under ?extraordinarily loose standards,? ?bringing the death penalty to a halt in the state. This is not a crazy concern: The backdrop here is the case of Melvin Davis Rees, who got a competency hearing and a stay courtesy of the Supreme Court in the mid-1960s?and died in prison in 1995, as Lyle Denniston points out on Scotusblog.
The Obama administration has weighed in against a rule that favors indefinite stays for death row inmates whose mental illness makes them incompetent. It?s too much to ask to stop all these cases, the government says. The American Psychiatric Association is on the other side, arguing that, for the sake of fairness, people who can?t help their lawyers shouldn?t be marched through their appeals. The American Bar Association wants a flexible standard for granting a stay, depending on the level of the defendant?s impairment and the circumstances of the case. It?s hard for me to imagine a lot of defendants who are deemed incompetent who could possibly work well with their lawyers?most of them are probably hallucinatory and delusional. That may not move a majority on the Supreme Court, though.
Fisher v. University of Texas at Austin, Wednesday, Oct. 10: The Supreme Court famously battled its way to a d?tente over affirmative action in 2003. In a pair of split-the-baby decisions, two different majorities struck down the use of quotas that favored historically disadvantaged racial minorities in public college admissions, but allowed schools to use race as one unquantified factor among many. Writing that second ruling, Justice Sandra Day O?Connor proclaimed her expectation that ?25 years from now, the use of racial preferences will no longer be necessary to further the interest approved today." O?Connor is gone from the court and so is her timeline. She has been replaced by Justice Samuel Alito, a dedicated foe of race-conscious policies, and that can only be good for Abigail Fisher, who is white, and who was denied admission to the University of Texas at Austin in 2008. UT, abiding by a 1997 state law, fills most of its class?more than 85 percent, the year Fisher applied?with the top 10 percent of the state?s high school graduates. For the remaining spots, the university takes race into account. Fisher wasn?t among the top 10 percent in her high school, so her argument is that she should have gotten one of the remaining spots?and did not because of affirmative action.
The last rationale that the Supreme Court accepted for maintaining some degree of affirmative action was diversity. Here?s Justice Lewis Powell speaking, in the other huge ruling in this arena, in 1978: ?The atmosphere of ?speculation, experiment, and creation??so essential to the quality of higher education?is widely believed to be promoted by a diverse student body.? In 2003, O?Connor noted the premium that ?major American businesses? and ?high-ranking retired officers and civilian military leaders? placed on exposure to people of different backgrounds in developing future employees and leaders. The retired military leaders and the Fortune 100 companies are back this time around, with briefs that include captions like ?Invalidating UT?s Modest Race-Conscious Admissions Policy Would Seriously Dispute the Military?s Efforts to Maintain Military Cohesion and Effectiveness.? We?ll see whether their continuing support for affirmative action matters. Justice Elena Kagan will sit this case out?she presumably worked on it during her time in the Obama Justice Department. If the court splits 4 to 4, Abigail Fisher will lose. But for that to happen, Justice Anthony Kennedy would have to join the liberal-moderate side. He didn?t go that way in 2003, or in the two major cases about race-conscious government policies since. Maybe his vote isn?t a foregone conclusion, though? We?ll know more soon enough.

We all know of the mystery subscription plan regarding NCSoft's upcoming action mmog Blade and Soul.
Following the launch of the western site for the game, in NCSoft's Q&A section, this was stated:
How much will Blade & Soul cost? Will there be a subscription fee, or will Blade & Soul utilize the microtransaction business model?
As the launch date draws nearer, we will have more information to share on price and business models. However NCsoft is actively evaluating what gaming fans in Europe and the United States want, and we are committed to creating a business model that will meet our fans' expectations.
Meaning that NCSoft is willing to listen to EU and NA followers of the game. With the recent success of GuildWars 2 and it's B2P model, should Blade and Soul (As well as future NCSoft MMOs) follow GW2's transaction model?
Pay to Play: is currently a dying breed in the mmo world (Ex. SWTOR, TERA, FFXIV, TSW) No one wants to spend money on games that don't deliver in content and far too easy to hit level cap, most of these have cash-shops that give advantages in-game despite the monthly fee on top, and if you are unable to pay the free, your access to the game is restricted until you pay to play it again, a lot of mmos released this year on this model due to severe lack of content and have turned, or are turning F2P. The exceptions being FFXI (10 years)?and WOW (9 years) still going strong in this model.
Buy to Play: Are a rare breed of mmo and only the Guild Wars franchise has seen huge success with this model, allowing players to play forever after buying the game with the option of buying aesthetically pleasing costumes that give no advantages in the game,, this plan can compete with P2P titles due to the aesthetical cash-shops and yearly expansions as a source of profitability players are able to have an equal advantage on content.
Free to Play: The model that currently saturates the market, a majority of games using this model are Pay 2 Win, buying items from cash-shops that give players advantages over other players who choose not to buy these items and would rather have equal advantage.
Hybrid Model: This model is fairly new, it uses the notion of limited content to players who don't subscribe to experience all of the game and limits a player's level if you choose the free to play option. Players who continue to subscribe to these models get to experience all content available in the game, while players who play free get left behind at a capped level are unable to advance.

Internet Marketing Plan
Online business owners who want to ensure higher traffic and profitability usually hires a professional internet marketing coach and online marketing consultant. The endeavor might cost some, but if you know how to choose the right person, then it can be one of the best decisions you could ever make for your venture. As you know, traffic is tantamount to your business? ability to make money. The higher the traffic, the more secure your profit becomes. Of course, you can exert efforts to attain this goal by yourself, but if you want to guarantee that things will go smoothly, then a coach can come in quite handy. In this article, let?s talk more about this job.
An internet marketing consultant?s primary responsibility is creating a marketing plan based on the objectives of a business. Naturally, you as an entrepreneur would have to work with him or her on this. You need to express your goals so he or she can devise tools, resources, and techniques to get there.Basically, there are four crucial things that an internet marketing coach can see you through: creating of content creation, Search Engine Optimization (SEO), marketing through social media, and building of links.
Creating content and SEO comes as a package because the former is always done under the consideration of the latter. When content about business marketing tips is made, it is made in such a way that will help optimize the site. On the other hand, social media marketing is letting the public know of your business through the use of social platforms like Facebook or Twitter. Then, building of links is about establishing connections with other well-respected sites to improve your own repute.
Besides these crucial jobs, there are other benefits internet marketing consulting can let you enjoy. For example, your coach can offer you individual or group courses that will train and educate you about online marketing. They are designed not just to make your site better but also to effectively instruct you on the continuing process of brand promotion. The courses can eventually get you ready in doing the job yourself. Hence, there may come a time when you won?t need to pay for a coach anymore. It will not only save cash but also provide you with the chance to grow better as a multi-skilled entrepreneur. Now, who wouldn?t want that?
There are indeed a lot of good things that can come out of hiring an online marketing consultant. Your only job is to look for one whom you can fully trust. An ideal coach must have years of experience in the field. It doesn?t matter much whether he or she works in a firm or individually. As long as he or she has a solid background and a portfolio as back up, then quality service can be ascertained. Taking risk in hiring an inexperienced internet marketing coach cannot warrant success as much a veteran can. Hence, if you want to play safe, go for a firm or a person who has been around for a reasonable time. Someone who knows the intricacies of the job even with eyes closed.

Yep, that was the plan. ?Except for one thing, I can't find my fall decorations! ?I ransacked every room in my house yesterday looking for them. ?I repeated "they're somewhere in this house" to myself as if that would help me find them. ?But....I failed to find them (head hung in shame).
As I sat among the chaos in my house last night, I began to dream of a room. ?A room in my house where I could walk in and there would be neatly labeled ?sections of my holiday and seasonal decorations. ?Everything was clean, organized and the room smelled like the inside of a Kirkland's store. ?Ahhh!
Snap! ?Back to reality. ?Frustrated, I searched Pinterest for some holiday/craft room organization images and tips. ?Since I have nothing to show you in this post, I'll share a little of what I found.
Here is where my dream holiday/craft storage room originated from. ?This is the home decor and craft storage room at Fox Hollow Cottage. ?Amazing, right? ?Go over there and tell Shannon how jealous you are of her room. ?Tell her I sent you and I want her to design my dream room. ?K?
I want a wall of shelves, floor to ceiling, full of craft supplies and holiday/seasonal decor items like this one.OK, I'm procrastinating again. ?I need to get back to my messy, disorganized house. ?I will continue my search for fall decor. ?I have a goal. ?I will not be out done by Miss Fancy-pants, "I have the perfect storage room" Shannon at Fox Hollow Cottage. ?

Most authors I?m sure do not have a very ton of know-how with developing a site. In the event you really don?t use a web page but are thinking about 1, the next few paragraphs sequence is known as a quality put to start out. This content is dedicated to describing domain title range as well as the internet internet hosting operation.
Every last writer wishes an internet site for promotional uses. Some authors pick out to produce a web site for every ebook they produce in the process. For those who determine your internet hosting business very well, you might host endless domains and website pages for only one regular monthly or annually cost.
The primary phase could be to decide your domain identify. Fiction authors most often use their very own identify for his or her domain identify, e.g., joeblow.com. Regardless, in the event you have a very totally typical identify, this type of as John Smith, or have been named soon after an now widely known man or woman, maybe you have some difficulty. The spot to begin for selecting domains is considered the WhoIs web pages. The following, you possibly can enter a domain title to uncover out if it really is presently taken or not, and get solutions on alternate alternatives if the wished-for domain title is taken. In addition, you possess the choice to backorder or talk to to acquire the domain title with the up-to-date proprietor. There is certainly merchants available on the market that exist exclusively to order up engaging domains and market them in a considerably bigger value into the community.
Any time you are an piece creator, copywriter or every other sort of author, domain identify options may well be far more complicated. Below, we wish to cease and discuss Search engine marketing for your minute. A single with the keys to brilliant internet search engine optimization will be to primarily have your key phrase in quite a lot of significant regions ? an individual of and that?s your domain identify. At any time you are really a novel writer, your identify (and maybe that you?re an creator) is a key element consideration. If, on the other hand, you furnish other kinds of composing or crafting products and services, items can potentially get complex. You might choose for ones industry identify ? people young and old could try to find you this way. But how about people today who you should not know you or your creating expert services exist?
A particular in the obstacles chances are you may face is the fact that you find yourself with domains which can be a mile prolonged. Even though this will not subject from the Search engine optimization standpoint, everyday people really don?t like tremendous extensive domains to style into their research bar. Attractiveness of one?s domain identify is truly a consider domain variety too. Another crucial phrase criteria embody your position, superlatives (e.g., the ?best? articlewriter.com) and what type of creating you need to do (e.g., businesswriter.com).
After you have your domain title picked out, you might be prepared to get it as well as your internet hosting provider. To generate issues hassle-free on you, acquire your domain title as a result of your internet hosting corporation. It might fee considerably less to the area, but more and more internet hosting establishments provide you with a particular 100 percent free domain title by using an internet hosting package deal. But, it is not going to damage anything at all once you aspire to protected the domain identify via WhoIs in advance of you may be wanting to host and design your website.
You will find very two methods of go in relation to world-wide-web host businesses: colossal and inclusive or smallish and specialised. I realize most authors preferring the specialised interest they get from neighborhood companies. Minimal organizations can also be significantly less tempting for hacking makes an attempt. In spite of this, community establishments generally please don?t have 24/7 program or perhaps the ability of much larger companies. That which you will need to seek within an internet hosting enterprise consists of:
Unrestricted domain internet hosting
Endless bandwidth utilization and space for storing
Unrestricted MySQL databases
24/7 client help
The ones would be the necessities; all else is mostly a perk or a possibility we?ll focus on inside an independent piece.
Expenses are commonly uniform through the business. Regardless, those that choose to possess a qualified professional model agency set up a customized internet site, watch out for agreeing to host your internet site with them. I?ve operate right into a moderately massive variety of such corporations that layout the website, host the positioning for an exorbitant cost and/or once a month control costs, and after that make transferring the location somewhere else exceedingly really difficult. In reality, we have now experienced to threaten some with authorized motion to receive them to launch the web-sites and/or deliver the web site information. These black hat providers are generally much less than advantageous in offering you course in the best way to make the transfer. They could also lock you into their internet hosting by making use of ?proprietary? styles and control techniques that are not transferrable outdoors their firm and that will set you back hundreds or hundreds to breed.
Although most designers and style suppliers are honest, service-oriented entities, it could be with your curiosity to try individual internet hosting as a way to safeguard all by yourself.
Another story during this sequence will tackle most of the add-on products accessible to you when selecting your internet hosting package deal. I?ll speak about the things they are, the things they do and which authors or writers would probably desire them.
Remember to refer to Cost Effective Hosting Will Not Imply A Top Quality Sacrifice, because the article provides you with more info over the topic.
